The Dutch Association of Lactation Experts (NVL), the WHO and the law make demands on the quality of actions of lactation experts.
WHO code:
The WHO code is known in full as the 'International Code of Conduct for the marketing of breast milk substitutes'. It means that parents must be able to choose their own food for their child, without influencing commercial parties. Thanks to the WHO code, advertising for baby food has been curtailed in the Netherlands under six months. The WHO code is more extensive than the Dutch Commodities Act or European laws and regulations. I adheres to the WHO code in its most comprehensive form.
I wholeheartedly endorse the WHO code. That is why I only work with brands and products from companies that also adhere to the WHO code. This is why I will not advertise for some brands.
The WHO Code seeks to:
* protect and promote breastfeeding
* ensure that parents receive appropriate and adequate information
* that breastmilk substitutes are used appropriately when needed
* that guidelines for the sale and advertising of baby food are followed
As a client, it is good to know how the lactation consultant IBCLC handles personal data. The lactation consultant IBCLC must be able to demonstrate that a processing complies with the main principles of processing. Such as legality, transparency, purpose limitation and correctness. (Accountability)
Privacy:
Since May 25, 2018, the General Data Protection Regulation (GDPR) applies. This means that from that date, the same privacy legislation will apply throughout the European Union (EU). In addition to this general law, specific rules apply to privacy in healthcare. These rules are stated, among other things, in the Medical Treatment Contracts Act (WGBO).
Data is not disclosed to third parties, including close relatives, without permission. The client must give permission for this. Due to the nature of her / his activities, the lactation consultant IBCLC has to comply with the Medical Professional Secrecy Act.
The IBLCE Code of Personal Conduct mentions professional secrecy by name and lactation experts IBCLC are obliged to abide by it. If the lactation consultant IBCLC feels compelled to release himself from professional secrecy, he / he will first check whether informing other care providers could solve the reason for removing the professional secrecy. In extreme situations, the lactation consultant IBCLC may consider turning to a judicial institution.
Processing of personal data:
Personal data is all data that can be traced back to a person. The lactation consultant IBCLC should ask permission to process data and need it for the execution of the agreement. She may only request information that is necessary for proper guidance. The data must be appropriately secured. In doing so, it complies with the principles for processing personal data. A lactation consultant with his own practice has no data protection officer.
